Terms of Service

1. Acceptance of Terms

By creating an account or using Mintain (“the App”), you agree to these Terms of Service. If you do not agree, do not use the App. You must be at least 18 years old to create an account.

2. What Mintain Does

Mintain is a home and equipment maintenance tracking tool. It helps you organize maintenance schedules, track service history, and receive reminders. Mintain is an organizational tool only — it does not perform maintenance, provide professional advice, or guarantee any outcome.

3. No Professional Advice

The maintenance schedules, intervals, and task templates provided in the App are general suggestions only. They do not replace:

• Manufacturer-recommended maintenance schedules for your specific vehicle, equipment, or home systems
• Advice from licensed mechanics, contractors, electricians, plumbers, or other professionals
• Your own judgment regarding the condition and needs of your property and equipment

You are solely responsible for determining the appropriate maintenance schedule, procedures, and parts for your property and equipment. Always consult your owner's manual and qualified professionals.

4. No Liability for Missed or Incorrect Maintenance

Mintain provides reminders as a convenience. We are not responsible for any damage, loss, injury, voided warranty, or other consequence resulting from:

• Maintenance tasks that were not performed or not performed on time
• Incorrect maintenance intervals, procedures, or parts
• Reliance on the App's suggested schedules or templates
• Decisions made based on information displayed in the App

You are solely responsible for maintaining your property, vehicles, and equipment regardless of whether the App reminds you to do so.

5. No Guarantee of Notifications or App Availability

Mintain uses push notifications and other reminder systems to alert you about upcoming and overdue maintenance. However, we do not guarantee that:

• Notifications will be delivered on time or at all
• The App will be available without interruption
• The App will be free of errors, bugs, or technical issues
• Data will be preserved indefinitely

Notification delivery depends on third-party services (including Apple, Google, and your internet service provider) that are outside our control. Device settings, operating system updates, network conditions, and other factors may prevent or delay notification delivery.

You should not rely solely on Mintain's notifications as your only reminder system for critical or time-sensitive maintenance tasks. The App is provided “as is” and “as available.”

6. Affiliate Links and Product Recommendations

The App may include links to third-party retailers where you can purchase parts and supplies. Some of these links are affiliate links, meaning Mintain may earn a commission if you make a purchase through them.

• Affiliate relationships do not affect which products or retailers are shown in the App
• Affiliate commissions do not increase the price you pay
• We are not responsible for the products, services, pricing, or policies of third-party retailers
• We do not endorse, warrant, or guarantee any third-party products or services

7. Your Account and Data

You are responsible for maintaining the security of your account credentials. You may delete your account at any time through the App's Settings.

We take reasonable steps to protect your data, but we do not guarantee that your data will be preserved indefinitely or that data loss will not occur. You are responsible for keeping your own records of critical maintenance history.

We may suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

8. User Responsibilities

You agree to:

• Provide accurate information when using the App (including mileage readings, service dates, and equipment details)
• Not use the App for any unlawful purpose
• Not attempt to interfere with the App's operation or security
• Not create multiple accounts or share account credentials

9. User-Generated Content

You may upload photos, notes, and custom maintenance information to the App (“User Content”). You retain ownership of your User Content. By uploading content to Mintain, you grant us a limited, non-exclusive license to host, store, display, and back up that content solely for the purpose of providing the App's services to you. This license ends when you delete the content or your account.

You agree not to upload content that:

• Contains malware, viruses, or harmful code
• Is illegal, obscene, or violates the rights of others
• Infringes on any third party's intellectual property
• Contains sensitive personal information belonging to someone else

We reserve the right to remove any User Content that violates these Terms without notice.

10. Fees and Payments

Mintain offers a free tier with limited features. Paid plans may be available with additional functionality. Specific features, pricing, and plan details are described within the App and may change from time to time.

For paid plans:

• Payment is processed through third-party payment providers. We do not store your payment information.
• All sales are final unless otherwise required by applicable law. Refund requests may be considered on a case-by-case basis by contacting us at support@mintain.com.
• We reserve the right to change pricing for future purchases or renewals. Existing paid users will be notified of any price changes in advance.
• If we discontinue a paid feature you have purchased, we will provide reasonable notice and, where appropriate, a prorated refund or alternative access.

Free tier features and limitations may change at our discretion. We will provide notice within the App of any material changes to the free tier.

11. Accuracy of Information

All maintenance schedules, task templates, suggested intervals, parts references, and other technical information provided in the App are for general informational purposes only. Mintain does not warrant the accuracy, completeness, timeliness, or usefulness of any technical data, part numbers, specifications, or maintenance intervals provided within the App.

Maintenance requirements vary significantly based on your specific vehicle, equipment, usage patterns, climate, age, condition, and other factors. The App's templates and suggestions are generic starting points and may not be appropriate for your situation. Always verify maintenance schedules against your owner's manual and consult qualified professionals.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mintain and its owners, operators, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or inability to use the App
• Your violation of these Terms
• Your violation of any rights of a third party
• Any User Content you upload to the App
• Any maintenance decisions you make based on information provided by the App
• Any property damage, personal injury, or other harm resulting from your use of the App

This indemnification obligation survives the termination of your account and these Terms.

13. Limitation of Liability

To the maximum extent permitted by law, Mintain and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of property, equipment damage, personal injury, lost profits, or data loss, arising from your use of or inability to use the App.

Our total liability for any claim related to the App shall not exceed the greater of (a) the amount you paid for the App in the 12 months preceding the claim, or (b) fifty dollars ($50).

14. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Changes to Terms

We may update these Terms at any time. If we make material changes, we will notify you through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States. Any disputes shall be resolved in the courts located in Lancaster County, Pennsylvania.

17. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
